Legal Notice

This Legal Notice governs access to the ITIA website and to every service attached to it, whether reached through a web browser, through the ITIA mobile application, or through any technical interface made available by the publisher. It applies to every visitor, with or without an account, and to the mere consultation of the Site as much as to the use of its most advanced features. Browsing the Site constitutes acknowledgement of this Notice.
1. Publisher
The ITIA website (the “Site”) is published by:

The publisher operates as a technology incubator, designs software solutions, sells digital projects and supports project founders. In doing so it acts sometimes as the designer and seller of its own work, and sometimes as the operator of a marketplace connecting third-party sellers with buyers. This distinction is decisive when assessing the extent of its liability: it is set out in Article 9 and developed in the Terms and Conditions of Sale.
2. Publication Director

3. Hosting and technical infrastructure
The Site and its services rely on infrastructure distributed across several specialised providers, each acting within a defined scope:

Payments are processed by Stripe Payments Europe, Limited (carte bancaire) et CamPay (Mobile Money MTN / Orange). Authentication may rely on Google Ireland Limited (connexion via Google). Video meetings held from the meeting area travel through 8x8 (Jitsi as a Service) servers. Email notifications are delivered by automation scenarios operated by Make. This distributed architecture means the publisher depends on third parties for the availability of the Site. A failure at any one of these providers may render all or part of the service unreachable without the publisher being able to remedy it immediately.
4. The publisher’s intellectual property
Every element making up the Site — architecture, navigation structure, editorial text, descriptions, visual identity, colour palette, typefaces, illustrations, icons, animations, photographs, videos, databases, source code and object code — is protected by intellectual property law and remains the exclusive property of the publisher or its licensors.
Any reproduction, representation, adaptation, translation, extraction, reuse, distribution or exploitation, in whole or in part, by any process and on any medium, without the publisher’s prior written authorisation, is strictly prohibited and constitutes infringement. This prohibition covers in particular the systematic extraction of data by automated means, the building of a competing database from the Site’s content, and the use of that content to train machine-learning models.
Permission to access the Site carries a strictly personal, non-exclusive, non-transferable and revocable right of use, limited to consultation and to the features expressly offered.
5. Trade marks and distinctive signs
The name ITIA, the ITIA logotype, its accompanying symbol, the names of the Site’s areas and features, and every distinctive sign appearing on it are the property of the publisher. Reproducing or using them — including as a commercial reference, for comparison, or as an advertising keyword — requires prior written agreement.
Third-party trade marks, logos and names appearing on the Site, in particular those of partners, technical providers and referenced clients, remain the property of their respective holders and are cited for information only.
6. Content published by users and sellers
The Site allows listed sellers to publish projects, descriptions, visuals and files, and users to post reviews, messages and attachments. Such content remains the property of its authors, who warrant its originality and lawfulness.
By publishing content on the Site, its author declares that they hold all necessary rights and grants the publisher a non-exclusive, royalty-free licence to reproduce and display it, limited to what is necessary for the display, promotion and proper operation of the service, for the duration of publication.
The publisher does not carry out systematic prior editorial review of such content. It nevertheless reserves the right to remove without notice any content that is manifestly unlawful, misleading, infringing, harmful to a third party’s rights, or contrary to this Notice.
7. Reporting unlawful content
Anyone who considers that content accessible on the Site infringes their rights or is unlawful may report it to contact@itia-web.com. To be handled effectively, a report must state the identity of the reporting party, the exact address of the content, a description of the facts and the legal basis relied upon.
The publisher acknowledges receipt and reviews the matter as promptly as possible. A manifestly abusive or bad-faith report engages the liability of its author.
8. Hyperlinks
The Site may contain links to external resources — partner websites, project demonstrations, social networks, technical documentation. These destinations lie outside the publisher’s control, and it cannot answer for their content, their availability, their personal-data practices or their evolution over time. Their presence constitutes neither endorsement, nor recommendation, nor warranty.
Creating a link to the Site is free where it points to the home page or to a public page, provided it creates no confusion as to the origin of the content and is not placed in a context damaging to the publisher’s image. Any other form of linking, in particular framing the Site within a third-party page, requires written agreement.
9. Availability of the service and limitation of liability
The publisher uses reasonable means to keep the Site accessible and the information published on it accurate, without undertaking an obligation of result. The Site is provided as is and as available.
Access may be suspended, restricted or interrupted, in particular for maintenance, updates, a provider failure, network saturation, a cyber-attack or an event of force majeure, without such interruption giving rise to any right to compensation.
The publisher shall not be liable for indirect damage such as loss of business, loss of opportunity, commercial prejudice, damage to reputation or loss of data, arising from access to the Site or from the inability to access it. It is for each user to take appropriate measures to protect their own equipment and data, in particular through regular backups and up-to-date security software.
These limitations do not apply in cases of gross negligence or wilful misconduct, nor where a mandatory provision precludes them.
10. Security and fair use
Users shall refrain from any action liable to compromise the integrity, security or availability of the Site. The following are prohibited in particular: attempting unauthorised access to an account, an administration area or a technical interface; introducing malicious code; deliberately overloading the servers; circumventing technical protection measures; and mass automated extraction of content.
Such conduct exposes its author to immediate suspension of access and to the proceedings provided for by Cameroonian Law No. 2010/012 of 21 December 2010 on cybersecurity and cybercrime.
11. Personal data
The processing of personal data is described in detail in the Privacy Policy, which forms an integral part of this Notice. Such processing is carried out in compliance with Cameroonian Law No. 2024/017 of 23 December 2024 on the protection of personal data and, for individuals residing in the European Union, with Regulation (EU) 2016/679 (GDPR).
12. Cookies and trackers
The Site uses only cookies strictly necessary for its operation, in particular to maintain the login session, preserve the chosen language and secure its forms. No advertising tracker and no profiling tool is placed. The details are set out in the Privacy Policy.
13. Accessibility
The publisher strives to make the Site usable by as many people as possible: sufficient contrast, keyboard navigation, alternative text, and a consistent heading hierarchy. Any difficulty encountered may be reported to contact@itia-web.com: every report is reviewed and corrected where technically feasible.
14. Amendments to this Notice
The publisher may amend this Notice at any time to reflect changes to the Site, its services or the applicable legal framework. The binding version is the one published on this page at the time of consultation; the date of last update appears at the top of the document.
15. Governing law and jurisdiction
This Legal Notice is governed by Cameroonian law, including the OHADA Uniform Acts applicable to general commercial law and to commercial companies.
Any dispute concerning its validity, interpretation or performance falls within the jurisdiction of the courts of Yaoundé, subject to mandatory rules protecting users established abroad. As the Site addresses an international clientele, consumers retain the benefit of the public-policy provisions of their country of residence, including where those provisions designate another jurisdiction.
Before any litigation, the parties shall endeavour to reach an amicable settlement. A complaint sent to contact@itia-web.com receives a reasoned reply within a reasonable time.
